1. Introduction

These Terms of Service ("Terms") govern your use of SpeechWay, a voice-to-documentation service for speech and language therapists. By creating an account or using SpeechWay, you agree to these Terms.

2. Service Description

SpeechWay provides a tool for speech and language therapists to:

• Record voice summaries of therapy sessions
• Automatically transcribe recordings into text
• Generate structured SOAP notes from transcriptions
• Store and manage client records and session history

3. Eligibility

SpeechWay is intended for use by qualified speech and language therapists or speech-language pathologists. By using SpeechWay, you confirm that you:

• Are a qualified speech and language professional or working under supervision of one
• Are at least 18 years old
• Have the authority to enter into these Terms
• Will use SpeechWay only for legitimate professional purposes

4. Your Account

You are responsible for:

• Maintaining the security of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorised access
• Ensuring your contact information is accurate and up to date

We may suspend or terminate accounts that violate these Terms or are used for fraudulent or illegal purposes.

5. Your Data Responsibilities

As a therapist using SpeechWay, you are the data controller for your clients' information. You are responsible for:

• Obtaining appropriate consent from clients (or their guardians) to record and process session information
• Complying with your professional body's codes of conduct
• Ensuring you have a lawful basis under GDPR to process client data
• The accuracy of information you enter into SpeechWay
• Maintaining your own records retention policies

6. Acceptable Use

You agree not to:

• Use SpeechWay for any unlawful purpose
• Share your account with others
• Attempt to access other users' data
• Interfere with or disrupt the service
• Reverse engineer or attempt to extract source code
• Use automated systems to access the service without permission
• Upload malicious content or attempt to compromise security

7. AI-Generated Content

SpeechWay uses artificial intelligence to transcribe audio and structure notes. You acknowledge that:

• AI-generated content may contain errors and must be reviewed before use
• You are responsible for verifying the accuracy of all generated notes
• AI-generated notes are suggestions and do not constitute clinical advice
• You retain full editorial control and responsibility for saved content

8. Subscription and Payment

Details of subscription plans, pricing, and payment terms will be provided when subscriptions are offered. During the beta period, SpeechWay may be offered free of charge.

When subscriptions are active:

• Subscriptions renew automatically unless cancelled
• You may cancel at any time; cancellation takes effect at the end of the billing period
• Refunds are provided in accordance with applicable consumer protection laws

9. Data Processing Agreement

For client data, SpeechWay acts as a data processor on your behalf. By using SpeechWay, you agree to our Data Processing Agreement, which forms part of these Terms. A full DPA is available on request at hello@speechway.io.

10. Intellectual Property

Your content: You retain ownership of all data you enter into SpeechWay, including client records and session notes.

Our service: SpeechWay, including its design, code, and documentation, is owned by us and protected by intellectual property laws. You receive a limited, non-exclusive licence to use the service for its intended purpose.

11. Availability and Support

We aim to provide reliable service but do not guarantee uninterrupted availability. We may perform maintenance or updates that temporarily affect access.

12. Limitation of Liability

To the maximum extent permitted by law:

• SpeechWay is provided "as is" without warranties of any kind
• We are not liable for clinical decisions made based on SpeechWay output
• Our liability is limited to the fees you have paid in the preceding 12 months
• We are not liable for indirect, incidental, or consequential damages

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

13. Termination

You may close your account at any time. Upon termination:

• You may request an export of your data before closure
• Your data will be deleted in accordance with our Privacy Policy
• Any outstanding fees remain payable

We may terminate or suspend your account for violation of these Terms, with notice where reasonably possible.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the application. Continued use after changes take effect constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
